1. Introduction

These Terms and Conditions govern access to and use of the Learning Management System (“LMS”) operated by Taryn G Training, Growth and Development (Pty) Ltd (“the Company”, “we”, “us”, “our”).

By accessing or using the LMS, you (“User”, “Learner”, “Client”) agree to be legally bound by these Terms and Conditions.

If you do not agree with these Terms, you must refrain from using the LMS.


2. Nature of Services

The LMS provides access to:

  • Accredited and/or non-accredited training programmes

  • Digital learning materials and assessments

  • Course resources and downloads

  • Virtual learning activities

  • Progress tracking and reporting

  • Certification upon successful completion (where applicable)

Access to specific courses is subject to enrolment and payment confirmation (where applicable).


3. User Registration and Account Security

3.1 Users must provide accurate and complete information during registration.
3.2 Login credentials are confidential and may not be shared.
3.3 Users are responsible for all activity conducted under their account.
3.4 The Company reserves the right to suspend or terminate accounts where misuse is detected.


4. Intellectual Property

4.1 All content available on the LMS, including but not limited to:

  • Course materials

  • Manuals

  • Videos

  • Assessments

  • Templates

  • Branding elements

remains the intellectual property of Taryn G Training, Growth and Development (Pty) Ltd unless otherwise stated.

4.2 Users may not:

  • Copy, reproduce, distribute, sell, or sublicense materials

  • Record or share training content

  • Modify materials without written consent

4.3 Access is granted strictly for personal learning or authorised corporate training purposes.


5. Payment Terms (Where Applicable)

5.1 Course access is granted only upon receipt of full payment unless otherwise agreed in writing.
5.2 All fees are quoted in South African Rand (ZAR).
5.3 Fees are non-refundable once course access has been activated, unless otherwise stipulated in a separate agreement.
5.4 Corporate clients remain liable for payment for enrolled learners.


6. Certification and Completion

6.1 Certification is issued only upon:

  • Successful completion of all required modules

  • Submission of required assessments

  • Demonstration of competence (for accredited programmes)

6.2 For accredited programmes, certification is subject to applicable SETA or QCTO processes where relevant.

6.3 The Company reserves the right to withhold certification where academic dishonesty is identified.


7. Learner Conduct

Users agree to:

  • Engage respectfully with facilitators and other learners

  • Submit original work

  • Avoid plagiarism or misrepresentation

  • Refrain from uploading harmful, unlawful, or offensive content

Any misconduct may result in suspension or termination of access without refund.


8. Data Protection and Privacy

8.1 The Company processes personal information in accordance with the Protection of Personal Information Act (POPIA) of South Africa.

8.2 By using the LMS, Users consent to the collection and processing of personal information for purposes including:

  • Enrolment and administration

  • Reporting to regulatory bodies (where applicable)

  • Certification and record keeping

8.3 User data will not be shared with third parties except:

  • Where required by law

  • Where necessary for accreditation and regulatory compliance

  • With authorised service providers supporting the LMS


9. Technical Requirements and Availability

9.1 Users are responsible for ensuring adequate internet connectivity and compatible devices.
9.2 The Company does not guarantee uninterrupted access to the LMS.
9.3 The Company reserves the right to perform maintenance or updates that may temporarily affect availability.


10. Limitation of Liability

10.1 The Company shall not be liable for:

  • Loss of data

  • Indirect or consequential damages

  • Technical disruptions outside of its reasonable control

  • Misuse of course content by Users

10.2 Participation in training does not guarantee employment, promotion, or specific career outcomes.


11. Amendments

The Company reserves the right to amend these Terms and Conditions at any time. Updated terms will be published on the LMS platform and become effective immediately upon publication.

Continued use of the LMS constitutes acceptance of revised terms.


12. Termination of Access

The Company may suspend or terminate access where:

  • Fees remain unpaid

  • Terms are breached

  • Fraud or misconduct is identified

  • Regulatory requirements necessitate action


13. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising shall be subject to the jurisdiction of South African courts.
